Terms of Service

Scramble is operated by Scramble Sports, Inc. ("we", "us"). These terms are an agreement between you and Scramble Sports, Inc., and they govern your use of Scramble. By creating an account or using the app, you agree to them. Please read the section below first. It's the most important thing on this page.

No gambling. No cash prizes. Nothing to redeem.

Scramble is a free game of skill. It is not gambling, and it is not a game of chance for money.

• You never wager anything to play, and there is no purchase necessary to participate.
• You cannot win real money, cash, gift cards, or any prize with monetary value.
• Points, streaks, multipliers, ranks, and any other in-game currency or score have no monetary value. They cannot be purchased with real money, exchanged for real money, cashed out, transferred outside the app, or redeemed for any good, service, or prize.
• Leagues and rooms you create or join with friends are for fun and bragging rights only.

If any feature of Scramble is ever changed to offer something of real-world value, that change will be described in an update to these terms before it takes effect, and will comply with the law of every jurisdiction it's offered in.

Eligibility

You must be at least 13 years old to create an account. If you're under the age of majority where you live, you represent that you have a parent or guardian's permission to use Scramble. You're responsible for making sure your use of Scramble complies with the laws that apply to you.

Your account

You're responsible for the activity on your account and for keeping your sign-in credentials secure. Tell us right away if you think your account has been compromised.

Account termination

You can stop using Scramble and request deletion of your account at any time. See our privacy policy for how. We may suspend or terminate your account, with or without notice, if you violate these terms, if we reasonably believe your account is being used for cheating, abuse, or fraud, or if we discontinue the app.

Acceptable use

You agree not to:

• use bots, scripts, emulators, or other automated tools to make predictions or interact with the game;
• exploit a bug, timing issue, or server error to gain points, rank, or any other advantage rather than reporting it;
• create or use multiple accounts to manipulate leagues, rankings, or streaks;
• harass, impersonate, or abuse other players, including through your handle, display name, or league names;
• attempt to access another user's account or data without authorization;
• interfere with or disrupt the game servers or infrastructure.

We may remove content, reset scores, or terminate accounts involved in any of the above.

Your content

You're responsible for the handle, display name, and league or room names you choose. They must not be obscene, harassing, impersonate another person or brand, or infringe anyone's rights. We may remove or change any of these if they violate this rule.

You keep ownership of the names you choose. So that Scramble can work, you give us permission to store your handle, display name, and league or room names, to show them to other players in the app, and to send the text of them to our moderation provider to screen for abuse before other people see them (see our privacy policy for who that is and what they receive). That permission is limited to running Scramble, and it ends when you delete the content or your account, apart from copies we're required to keep by law and copies that sit in routine backups until those backups age out.

Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GAME DATA (INCLUDING SCORING BASED ON REAL-WORLD PLAY DATA) WILL ALWAYS BE ACCURATE OR AVAILABLE THE MOMENT A PLAY HAPPENS.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCRAMBLE AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR OPPORTUNITY, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED US DOLLARS ($100).

Some places don't allow some of these exclusions or limits. Where that's true, the parts that aren't allowed simply don't apply to you, and the rest of this section still stands. Nothing in these terms limits any liability that can't be limited by law.

Resolving disputes

If something goes wrong, email support@scramblefantasy.gg and describe the problem. Almost everything gets sorted out this way, and we'd rather hear from you than not. Please give us 30 days to work it out with you before starting any formal proceeding.

Governing law

These terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles. Any dispute that isn't settled the way the section above describes will be brought in the state or federal courts located in Washington, and both of us consent to those courts deciding it. If the law where you live gives you consumer protections you can't waive by agreement, nothing here takes them away from you.

Changes to these terms

We may update these terms from time to time. If we make a material change, we'll update the "Last updated" date above and, where required, notify you in the app before the change takes effect. Continuing to use Scramble after a change takes effect means you accept the updated terms.

Not affiliated with the NFL

Scramble is an independent game. It is not affiliated with, endorsed by, or sponsored by the National Football League (NFL), the NFL Players Association (NFLPA), any NFL team, or any individual player. All team names, player names, and league marks referenced in the app belong to their respective owners and are used only to describe and score real, publicly reported game events.
